By using our services, you are agreeing to these terms which set out the agreement between Protego (Private) Limited and you. Please read them carefully.

Introduction

By visiting fikrnat.com website or using the fikrnat mobile application and accessing the resources and any and all associated services (together, the “Services”)  Protego (Private) Limited, a company incorporated under the laws of Pakistan having its registered office at [165/3, 28 Street, Khayaban e Muhafiz, Phase 6, DHA, Karachi, Sindh, Pakistan] (hereinafter referred to as “Protego”, “we”, “our” , “us”) provide, you understand and agree to accept and adhere to the following terms and conditions as stated in these Terms of Service (“Terms”). If you do not agree to be bound by these Terms in their entirety, you may not access or use the Services. We only grant use and access to the fikrnat mobile application and the fikrnat.com website and its Services to those who have accepted the Terms.

Modification Of Terms

Protego reserves the right to change the Terms from time to time without notice. You acknowledge and agree that it is your responsibility to review these Terms periodically to familiarize yourself with any modifications. Your continued use of any of the Services after such modifications will constitute acknowledgement and agreement of the modified Terms.

You may be updated on any modifications in the Terms and privacy policy via email as provided by you. We do not offer physical mail deliveries of such notices and are not responsible for unread email notices.

By visiting fikrnat.com website or using the fikrnat mobile application and accessing and/or utilizing the Services, either directly or indirectly, you agree to use these Services only for the purposes intended as permitted by the Terms, and applicable laws and regulations. You agree that failure to adhere to any of these conditions constitutes a material breach of these Terms.

  • In order to access our Services you may be required to provide certain information about yourself as part of the registration process, or as part of your ability to use the Services. You agree that any information you provide will always be accurate, correct, and up to date and won’t provide false or inaccurate information when registering an account.

Accordingly, you are responsible for all activities that occur under your account(s) or password. If you think there are any possible issues regarding the security of your account on the app, inform us immediately so we may address them accordingly.

  • Engaging in any activity that disrupts or interferes with our Services, including the servers and/or networks to which our Services are accessible, is strictly prohibited.
  • You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.
  • By accepting these terms and conditions, you hereby allow/empower Protego and its subsidiary services like Fikrnat mobile app to access your personal data maintained with NADRA and/or CPLC and use the same for the specific purpose of providing security services.
  • You agree to indemnify and hold harmless Protego and our shareholders and affiliates including Probyn Security Advisors (Private) Limited (“Probyn”), and their respective directors, officers, managers, employees, donors, agents, licensors, from and against all losses (including but not limited to loss of life), physical or mental injury, or harm, expenses, damages and costs, including reasonable attorneys’ fees, resulting from use or misuse of Services, any violation of these Terms or the failure to fulfil any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under the Terms. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Payment For The Services

You are required to make payment for the use of the Services that you order, and which are accepted in accordance with the service order filled out and the rates applicable thereto.  All taxes, including but not limited to sales tax, payable for the provision of Services are to your account.

Limitation of Warranties

By using our fikrnat.com website or using the fikrnat mobile application and accessing and/or utilizing the Services, you understand and agree that all Services are provided on an “as is” and “as available” basis.

Limitation of Liability

You expressly understand and agree that any claim against us and our service providers shall be limited to the amount you paid, if any, for the use of the Services. Protego provides the Services through a licensed third-party security services provider,  Probyn SECURITY ADVISORS (PRIVATE) LTD, and Protego or Probyn SECURITY ADVISORS (PRIVATE) LTD INCLUDING THEIR RESPECTIVE DIRECTORS, SHAREHOLDER, EMPLOYEES AND AGENTS will not be liable for any direct, indirect, incidental, consequential or exemplary loss (INCLUDING LOSS OF LIFE), harm, PHYSICAL OR MENTAL INJURY, or damages which may be incurred by you or any other person as a result of using our Services.

Copyrights, Trademarks And Intellectual Property

You acknowledge and agree that we and our licensors retain ownership of all intellectual property rights of any kind related to the Services, including applicable copyrights, trademarks, and other proprietary rights. Other product and company names that are mentioned on the Services may be trademarks of their respective owners. We reserve all rights that are not expressly granted to you under these Terms.

All content and materials available on the fikrnat.com website or the fikrnat mobile application, including but not limited to text, graphics, website name, code, images, and logos are the intellectual property of Protego – and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited unless specifically authorized by Protego (Private) Limited.

Termination of Use

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website, our mobile application and Services, terminate accounts, and cancel orders with or without notice and for any reason, including, without limitation, breach of these Terms. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Services we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.

Governing Law

 

fikrnat.com website and the fikrnat mobile application is operated and controlled from our offices located in, Pakistan. However as both the application and website can be accessed in most countries around the world and as each country has laws that may differ from those of Pakistan, by accessing our website or application, you agree that the statutes and laws of Pakistan, without regard to the conflict of laws, will apply to all matters relating to the use of this website and the fikrnat mobile application and the purchase of any products or services through fikrnat.com website or the fikrnat mobile application. Furthermore, any action to enforce the Terms shall be brought in the courts located in, Pakistan. You hereby agree to personal jurisdiction by such courts and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Guarantee

Unless otherwise expressed, Protego expressly disclaims all warranties and conditions of any kind. Whether expressed or implied, including but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

Force Majeure

Protego shall not be liable for any loss, damage or delay in the provision of Services due to acts of God or causes beyond its reasonable control including acts of the Customer, acts of civil or military authority, fires, strikes, floods, epidemics, quarantine restrictions, war, riots, delays in transportation, transportation embargoes, or inability due to causes beyond its reasonable control to obtain necessary security guards.
